It is your responsibility to periodically review these Terms to stay informed of updates. Your continued use of the Platform after any such modifications constitutes your acceptance of the revised Terms.

Eligibility:

To use the Services on the Platform, you must be at least 18 years of age and capable of entering into a legally binding contract under applicable Indian law. If you are under 18, you may use the Platform only with the involvement and consent of a parent or guardian.

Account Registration:

To access certain features of the Platform (e.g., placing orders, selling products), you may be required to register for an account. You agree to provide true, accurate, current, and complete information during registration and keep your account information updated.

Account Security:

You are solely responsible for maintaining the confidentiality of your account password and other credentials. You are responsible for all activities that occur under your account, whether or not you have authorized such activities. You agree to notify EffortMart immediately of any unauthorized use of your account or any other breach of security. EffortMart will not be liable for any loss or damage arising from your failure to protect your account details.

Suspension and Termination:

EffortMart reserves the right to suspend, terminate, or restrict your access to your account or the Platform, without liability or prior notice, for any reason whatsoever, including, but not limited to, breach of these Terms, fraudulent activity, or if we believe it is in the best interest of the Platform or other users.

EffortMart operates as an online marketplace where various third-party sellers ("Vendors" or "Third-Party Sellers") offer products alongside those sold directly by EFRTMRT INTERNET PRIVATE LIMITED .

Intermediary Role:

You acknowledge and agree that EffortMart is primarily an intermediary that provides a platform for buyers and sellers to interact and transact.

Seller Responsibility:

For products sold by Third-Party Sellers, EffortMart is not the manufacturer, seller, or direct service provider. The respective Third-Party Seller is solely responsible for the product's quality, accuracy of listing, merchantability, fitness for a particular purpose, pricing, compliance with applicable laws (e.g., Legal Metrology, product safety), and any warranties or guarantees. Your purchase from a Third-Party Seller constitutes a contract between you and that seller.

EffortMart's Limited Liability (Third-Party Products):

To the fullest extent permitted by law, EffortMart shall not be responsible or liable for any defects, non-delivery, delays, quality issues, or any other claims arising from products or services offered, sold, or delivered by Third-Party Sellers on the Platform. We do not endorse, guarantee, or assume responsibility for the actions, omissions, or products of Third-Party Sellers.

Seller Terms:

If you are a seller, your use of the Platform is also governed by separate "Seller Terms and Conditions" which you must agree to, in addition to these general Terms.

Accuracy of Information:

We strive to ensure that product descriptions, images, and pricing for products sold directly by EffortMart are accurate. For products listed by Third-Party Sellers, the respective seller is responsible for the accuracy of their listings. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Pricing:

All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. Shipping charges, if any, will be clearly indicated at checkout.

Order Placement:

When you place an order on the Platform, you are making an offer to purchase the selected product(s) from EffortMart or the respective Third-Party Seller.

Order Acceptance:

An order is considered "accepted" only when EffortMart (or the Third-Party Seller) dispatches the product(s) to you. An order confirmation email/message does not signify acceptance; it merely confirms receipt of your order.

Right to Refuse/Cancel Orders:

EffortMart and Third-Party Sellers reserve the right to refuse or cancel any order at their sole discretion, including but not limited to, cases of product unavailability, errors in pricing or product information, suspected fraud, or violation of these Terms. If your order is cancelled after payment, the amount will be refunded according to our Refund & Return Policy.

Payment Methods:

EffortMart accepts various payment methods, including credit/debit cards, Net Banking, UPI, and other digital payment options as available on the Platform.

Payment Processing:

All payments are processed through secure third-party payment gateways. EffortMart does not store your sensitive payment information (e.g., full credit card details).

Payment Obligations:

You agree to pay us the charges associated with availing the Services and confirm that the payment method used is yours or you have the necessary authorization to use it.

Payment Failures/Chargebacks:

In case of payment failures or chargebacks, EffortMart reserves the right to take necessary action, including but not limited to, suspension of your account and recovery of dues.

You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal, forbidden by these Terms, or by Indian or local laws that might apply to you. Prohibited activities include, but are not limited to:

• Posting or transmitting any unlawful, threatening, abusive, defamatory, obscene, vulgar, or otherwise objectionable content.
• Engaging in fraudulent activities, including but not limited to, making false purchases, misrepresenting identity, or using unauthorized payment methods.
• Violating any intellectual property rights of EffortMart, Third-Party Sellers, or other users.
• Distributing viruses, malware, or any other harmful computer code.
• Attempting to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform.
• Interfering with the operation of the Platform or any transactions conducted on the Platform.
• Collecting or harvesting any personally identifiable information from the Platform without explicit consent.
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity.
• Spamming, phishing, or sending unsolicited communications.

The Platform allows users to post content, including but not limited to product reviews, review images, and attachments on support tickets (limited to images/videos for reviews).

Responsibility for Content:

You are solely responsible for any content you submit, post, or display on the Platform. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize EffortMart to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all user-generated content.

License Grant:

By submitting content to EffortMart, you grant EffortMart a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the user-generated content in connection with the Platform's operation and promotion, across any media formats and channels.

Content Standards:

You agree not to post user-generated content that is illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy, or otherwise injurious or objectionable to third parties.

Monitoring and Removal:

EffortMart does not endorse, control, or assume any responsibility for user-generated content. However, we reserve the right (but not the obligation) to monitor, edit, or remove any user-generated content that, in our sole discretion, violates these Terms or is otherwise objectionable, without prior notice.

Disclaimer:

To the maximum extent permitted by applicable law, EffortMart will have no liability related to user content arising under intellectual property rights, libel, privacy, publicity, obscenity, or other laws. The Platform also disclaims all liability with respect to the misuse, loss, modification, or unavailability of any user content.

The contents of the Platform and the Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, software, and the compilation of all content on the Platform, are the property of EFRTMRT INTERNET PRIVATE LIMITED or its content suppliers and are protected by Indian and international copyright, trademark, and other intellectual property laws.

You will not have any authority to claim any intellectual property rights, title, or interest in its contents unless explicitly granted in writing.

Unauthorized use of the Platform or the Services, including reproduction, redistribution, transmission, modification, or public display of any content, may lead to action against you as per these Terms or applicable laws.

"As Is" Basis:

The Platform and the Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Accuracy:

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this Platform or through the Services for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Informational Content:

Any buying tips, guides, or recommendations provided on the Platform are for general informational and promotional purposes only and are not guaranteed to be 100% accurate. You acknowledge that any reliance on such information is strictly at your own risk.

Service Availability:

We do not warrant that the Platform will always be secure, error-free, or function without delays, disruptions, or imperfections. While we aim to provide uninterrupted service, temporary unavailability due to technical issues beyond our control may occur. We endeavor to inform users of planned maintenance downtimes at least 72 hours in advance.

Third-Party Links:

The Platform may contain links to other third-party websites or resources. On accessing these links, you will be governed by the terms of use, privacy policy, and such other policies of such third-party websites. EffortMart has no control over these external sites and is not responsible for their content or availability.

Your use of our Services and the Platform is solely at your own risk and discretion. You are required to independently assess and ensure that the Services meet your requirements.

EFRTMRT INTERNET PRIVATE LIMITED will not be responsible for any damage suffered by users from the use of the Platform or the content available on it. This includes but is not limited to loss of revenue/data resulting from delays, computer viruses, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

In no event will EFRTMRT INTERNET PRIVATE LIMITED be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the Platform.

Notwithstanding anything to the contrary contained herein, the maximum aggregate liability of EFRTMRT INTERNET PRIVATE LIMITED for any claims arising out of or in connection with your use of the Platform shall not exceed INR 1,00,000 (Rupees One Lakh Only).

You agree to indemnify, defend, and hold harmless EFRTMRT INTERNET PRIVATE LIMITED , its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your breach of these Terms, your misuse of the Platform, your violation of any law or the rights of a third party, or any content you submit or post on the Platform.

You shall be entitled to claim a refund of the payment made by you in case we are not able to provide the Service or product as per our policies. The timelines for such return and refund will be according to the specific Service/product you have availed or within the time period provided in our Refund & Return Policy and Cancellation Policy, which are available as separate dedicated pages on the Platform. In case you do not raise a refund or cancellation claim within the stipulated time, then this would make you ineligible for a refund.

All terms related to shipping methods, delivery timelines, and associated costs are governed by our Shipping & Delivery Policy, which is available as a separate dedicated page on the Platform.

Notwithstanding anything contained in these Terms, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Shahjahanpur, Uttar Pradesh, India.

EffortMart SellerZone is our dedicated platform for sellers and vendors to manage their products, orders, and business operations on EffortMart. The following terms specifically apply to SellerZone users:

SellerZone Registration and Verification:

• Sellers must complete the registration process and provide accurate business information, including GSTIN, PAN, and bank details.
• EffortMart reserves the right to verify all seller information and documents before activating a SellerZone account.
• Only registered businesses or individuals with valid business documents can create SellerZone accounts.

Product Listing Requirements:

• Sellers must ensure all product listings comply with Indian laws, including Legal Metrology Act, 2009.
• Accurate product descriptions, images, and pricing must be maintained.
• Prohibited and restricted items as per EffortMart's policies cannot be listed.
• All products must comply with safety standards and applicable certifications.

Order Fulfillment and Shipping:

Sellers are responsible for timely order processing, packaging, and shipping. SellerZone provides tools for order management, but ultimate responsibility lies with the seller.

Payment and Settlements:

• Payment settlements are processed according to EffortMart's payment cycle.
• Sellers must maintain accurate bank details for settlements.
• All applicable taxes (GST, TCS) are deducted as per government regulations.
• Chargebacks and refunds are adjusted from pending settlements.

Performance Standards:

• Sellers must maintain minimum performance standards for order fulfillment, customer service, and product quality.
• Poor performance may result in account suspension or termination.
• Sellers must maintain a minimum rating as specified in SellerZone policies.

Compliance Requirements:

• Sellers must comply with all applicable laws including GST, Income Tax, and Consumer Protection Act.
• Proper invoices must be generated for all sales.
• Sellers are responsible for product warranties and guarantees.
• All returns and refunds must be processed as per EffortMart's policies.

Fees and Commissions:

Sellers agree to pay applicable commissions and fees as specified in the SellerZone agreement. These may include platform fees, payment gateway charges, and shipping fees.

All concerns or communications relating to these Terms, or any other issues regarding your use of the Platform or Services, must be communicated to us using the contact information provided below. We are committed to addressing your concerns in a timely and effective manner.

We have a dedicated Grievance Officer whose details will be made available soon, in compliance with applicable Indian e-commerce and IT laws.

Severability:

Each paragraph of these Terms shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise expressly indicated or indicated by the context of the agreement. The decision or declaration that one or more of the paragraphs are null and void shall not affect the remaining paragraphs of these Terms.

Entire Agreement:

These Terms constitute the entire agreement between you and EffortMart regarding the use of the Platform and Services, superseding any prior agreements between you and EffortMart.

Assignment:

You may not assign or transfer these Terms, by operation of law or otherwise, without EffortMart's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. EffortMart may assign or transfer these Terms, at its sole discretion, without restriction.
