These Terms and Conditions, along with our Privacy Policy, Refund & Return Policy, and Cancellation Policy (collectively, \"Terms\"), constitute a binding agreement by and between EFRTMRT INTERNET PRIVATE LIMITED ( \"Website Owner,\" \"EffortMart,\" \"we,\" \"us,\" or \"our\") and you (\"you\" or \"your\"). These Terms govern your access to and use of our website and mobile applications (hereinafter collectively referred to as the \"Platform\") and the products and services (collectively, \"Services\") offered thereon.

\n\n

1. Acceptance of Terms

\n

\n By accessing, browsing, or using the Platform and availing the Services, you acknowledge that you have read, understood, and accepted these Terms, including the Privacy Policy, Refund & Return Policy, and Cancellation Policy. If you do not agree with these Terms, you must not use or access the Platform.\n

\n

\n We reserve the right to modify, amend, or update these Terms at any time without prior notice or assigning any reason. It is your responsibility to periodically review these Terms to stay informed of updates. Your continued use of the Platform after any such modifications constitutes your acceptance of the revised Terms.\n

\n\n

2. Eligibility and User Accounts

\n

Eligibility:

\n

\n To use the Services on the Platform, you must be at least 18 years of age and capable of entering into a legally binding contract under applicable Indian law. If you are under 18, you may use the Platform only with the involvement and consent of a parent or guardian.\n

\n

Account Registration:

\n

\n To access certain features of the Platform (e.g., placing orders, selling products), you may be required to register for an account. You agree to provide true, accurate, current, and complete information during registration and keep your account information updated.\n

\n

Account Security:

\n

\n You are solely responsible for maintaining the confidentiality of your account password and other credentials. You are responsible for all activities that occur under your account, whether or not you have authorized such activities. You agree to notify EffortMart immediately of any unauthorized use of your account or any other breach of security. EffortMart will not be liable for any loss or damage arising from your failure to protect your account details.\n

\n

Suspension and Termination:

\n

\n EffortMart reserves the right to suspend, terminate, or restrict your access to your account or the Platform, without liability or prior notice, for any reason whatsoever, including, but not limited to, breach of these Terms, fraudulent activity, or if we believe it is in the best interest of the Platform or other users.\n

\n\n

3. The Platform as an Intermediary (Multi-Seller Model)

\n

\n EffortMart operates as an online marketplace where various third-party sellers (\"Vendors\" or \"Third-Party Sellers\") offer products alongside those sold directly by EFRTMRT INTERNET PRIVATE LIMITED .\n

\n

Intermediary Role:

\n

\n You acknowledge and agree that EffortMart is primarily an intermediary that provides a platform for buyers and sellers to interact and transact.\n

\n

Seller Responsibility:

\n

\n For products sold by Third-Party Sellers, EffortMart is not the manufacturer, seller, or direct service provider. The respective Third-Party Seller is solely responsible for the product's quality, accuracy of listing, merchantability, fitness for a particular purpose, pricing, compliance with applicable laws (e.g., Legal Metrology, product safety), and any warranties or guarantees. Your purchase from a Third-Party Seller constitutes a contract between you and that seller.\n

\n

EffortMart's Limited Liability (Third-Party Products):

\n

\n To the fullest extent permitted by law, EffortMart shall not be responsible or liable for any defects, non-delivery, delays, quality issues, or any other claims arising from products or services offered, sold, or delivered by Third-Party Sellers on the Platform. We do not endorse, guarantee, or assume responsibility for the actions, omissions, or products of Third-Party Sellers.\n

\n

Seller Terms:

\n

\n If you are a seller, your use of the Platform is also governed by separate \"Seller Terms and Conditions\" which you must agree to, in addition to these general Terms.\n

\n\n

4. Product Listings, Pricing, and Orders

\n

Accuracy of Information:

\n

\n We strive to ensure that product descriptions, images, and pricing for products sold directly by EffortMart are accurate. For products listed by Third-Party Sellers, the respective seller is responsible for the accuracy of their listings. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.\n

\n

Pricing:

\n

\n All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. Shipping charges, if any, will be clearly indicated at checkout.\n

\n

Order Placement:

\n

\n When you place an order on the Platform, you are making an offer to purchase the selected product(s) from EffortMart or the respective Third-Party Seller.\n

\n

Order Acceptance:

\n

\n An order is considered \"accepted\" only when EffortMart (or the Third-Party Seller) dispatches the product(s) to you. An order confirmation email/message does not signify acceptance; it merely confirms receipt of your order.\n

\n

Right to Refuse/Cancel Orders:

\n

\n EffortMart and Third-Party Sellers reserve the right to refuse or cancel any order at their sole discretion, including but not limited to, cases of product unavailability, errors in pricing or product information, suspected fraud, or violation of these Terms. If your order is cancelled after payment, the amount will be refunded according to our Refund & Return Policy.\n

\n\n

5. Payment Terms

\n

Payment Methods:

\n

\n EffortMart accepts various payment methods, including credit/debit cards, Net Banking, UPI, and other digital payment options as available on the Platform.\n

\n All payments are processed through secure third-party payment gateways. EffortMart does not store your sensitive payment information (e.g., full credit card details).\n

\n

Payment Obligations:

\n

\n You agree to pay us the charges associated with availing the Services and confirm that the payment method used is yours or you have the necessary authorization to use it.\n

\n

Payment Failures/Chargebacks:

\n

\n In case of payment failures or chargebacks, EffortMart reserves the right to take necessary action, including but not limited to, suspension of your account and recovery of dues.\n

\n

\n

\n EffortMart does not endorse, control, or assume any responsibility for user-generated content. However, we reserve the right (but not the obligation) to monitor, edit, or remove any user-generated content that, in our sole discretion, violates these Terms or is otherwise objectionable, without prior notice.\n

\n

Disclaimer:

\n

\n To the maximum extent permitted by applicable law, EffortMart will have no liability related to user content arising under intellectual property rights, libel, privacy, publicity, obscenity, or other laws.
